This stems from my own misunderstanding of how the visibility settings for names work. Apologies!
In the current implementation of the new names form I noticed that the 'Visibility' section was not at the bottom of the form as it is on pretty much every other form. It then occurred to me why that was - the visibility setting on this form affects the given, family and published names.
The original design does not make this clear at all. Hence the out-of-sequence visibility section.
I have revisited the design for the names form, making some small but important changes that should help to make this form easier to understand and use. The updates are detailed here in Figma:
